Where Professional Law covers how someone becomes licensed and where the legal boundaries of practice sit, this section covers what a regulator does once a person or firm already holds a licence: how it responds when something goes wrong, how it checks that members stay competent, and how it holds firms accountable through the person named on their permit. Because this section carries relatively few questions, the exam tends to test whether you can correctly classify a short scenario rather than recite statute numbers: is this an enforcement matter against someone unlicensed, a discipline matter against a member, or a routine competence check that carries no penalty at all? Keep that distinction in mind as you work through each sub-topic, and remember that across every scenario here, protecting the public is the value that breaks any tie.
VI.1 Discipline Procedures
7 min readThe exam expects you to recognize the statutory grounds that can trigger discipline against a licensed member, to place the stages of a typical disciplinary process in order, and to know the general range of penalties a discipline committee can impose. Questions are usually short scenarios: a member does something questionable, and you must identify which ground applies, what stage a matter has reached, or what the most appropriate next step is. A second recurring test is distinguishing discipline, which a regulator conducts, from a lawsuit, which a court conducts.
Engineering and geoscience are self governing professions: the same associations that license members are also responsible for policing them. That arrangement rests on two separate powers. Enforcement is the power to act against people who are not licensed at all, including anyone using a protected title such as Professional Engineer without the right to do so. Discipline is the power to act against people who already hold a licence but who fall short of what the profession expects of them. The exam draws this line sharply, so before answering a scenario question, decide which power is actually in play.
VI.2 Practice Review of Individuals
3 min readFor practice review of individuals, the exam expects you to know that it is a routine, non punitive audit used to confirm that a member's reported continuing education is accurate, not a response to a complaint. Expect a scenario that asks you to tell a random practice review apart from a disciplinary investigation, or that asks what a member should do once selected for one.
A system that lets members self report their own continuing education needs some way to confirm the reports are honest. Rather than checking everyone, most associations draw a small random sample of members each year and verify that the activities those members reported actually happened and were properly credited. That check is a practice review, and on the exam it needs to be kept firmly apart from discipline: nobody is chosen because they did something wrong, and being chosen implies no wrongdoing at all.
VI.3 Practice Review of Firms
3 min readThe blueprint names practice review of firms as examinable, but the underlying material tests whether you understand how a firm, as distinct from an individual, is held accountable: through a permit to practise or certificate of authorization that names a real, licensed person as personally responsible for the firm's work. Expect scenario questions about who is exposed to discipline when a firm's output turns out to be deficient.
A corporation cannot exercise professional judgment the way a person can, so licensing a firm raises an obvious question: if the firm itself is licensed, who actually answers for the quality of its work? Every province solves this the same basic way. A firm that offers engineering or geoscience services to the public must hold a separate licence, usually called a permit to practise or a certificate of authorization, and that licence must name at least one licensed member who personally supervises the firm's professional work and personally accepts responsibility for it.
VI.4 Continuing Professional Development
4 min readFor CPD, the exam expects you to know why continuing education is required, the general shape of a compliant program, and how to classify different kinds of professional development activity. Expect scenario questions about how a member should handle a change in circumstances, such as a leave or a career gap, or questions that ask you to identify which of a set of activities would reasonably count toward CPD.
A licence earned once does not stay current forever. Engineering and geoscience knowledge moves quickly enough that skills learned in school can become outdated well before a career ends, so every code of ethics includes a duty to keep your own competence current. Continuing professional development, usually shortened to CPD, is how associations turn that ethical duty into a program members can actually follow and report on.
